OVERVIEW

Welcome to Great Spirit Designs (“Great Spirit Designs”, “we”, “us”, “our”). We operate this website and store, along with all related content, features, tools, products, and services (the “Services”). Our store is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service (“Terms”) together with the policies referenced here (including our [Privacy Policy] and [Refund & Exchange Policy]) describe your rights and responsibilities when using the Services. By visiting, interacting with, or purchasing from the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.

1. ACCESS & ACCOUNT

You represent that you are at least the age of majority in your province/territory (or you have consent for any minor dependents using devices you own/manage). You may be asked to provide certain information (e.g., email, billing, shipping, payment). You warrant the information you provide is accurate and that you have rights to provide it. You are responsible for maintaining the security of your account credentials and all activity under your account.

2. OUR PRODUCTS (HANDMADE VARIATION)

We make every effort to display colors and details accurately, but appearance may vary by device/screen. Many items are handmade; slight variations in color, texture, dimensions, pattern placement (including tie dye), leather grain/marks, and finish are part of their character and not defects. Beeswax color and honey aroma may vary by batch.

We do not warrant products will meet personal expectations. Product descriptions, pricing, and availability may change at any time without notice. We may limit quantities or discontinue products at our discretion.

Safety notes:

  • Candles: Burn on a heat-safe surface, within sight, away from drafts/flammables, and out of reach of children and pets. Trim wick to ¼″ before each burn. Do not leave unattended.

  • Knives: Sold to adults only. See Section 3 (Orders) for age and compliance requirements.

  • Leather/Tie Dye Care: See FAQs and product pages for care guidance.

3. ORDERS

Placing an order is an offer to buy. We may accept or decline any order at our discretion. Orders are accepted once payment is processed and we send confirmation. Review your order carefully before submitting; we may be unable to cancel after acceptance. If we change or cancel an order, we will attempt to notify you using the contact information provided.

Purchases are subject to our [Refund & Exchange Policy]. You warrant purchases are for personal/household use, not for resale or export.

Knives (age & compliance): By purchasing knives or sheaths, you confirm you are 18+ (or the age of majority where you live) and that it is lawful for you to purchase, possess, and use such items in your jurisdiction. You are responsible for complying with all applicable laws. We may cancel knife orders that appear non-compliant.

4. PRICES & BILLING

Prices, discounts, and promotions may change without notice. The price charged is the price in effect at checkout and in your order confirmation. Unless stated otherwise, prices exclude taxes, shipping, handling, customs, or import charges. Online prices may differ from market/event prices.

You agree to provide current, complete, and accurate purchase and payment information and to promptly update it so we can complete your transactions. You represent that you’re authorized to use the payment method and will pay all charges including applicable taxes and shipping.

5. SHIPPING & DELIVERY

We currently ship within Canada (and may expand; see [Shipping Policy]). Delivery times are estimates and not guaranteed. We are not responsible for carrier delays, customs processing, weather, or events beyond our control. Title and risk of loss transfer to you when we hand off the order to the carrier. For local pickup (if offered), we will contact you to arrange details.

6. INTELLECTUAL PROPERTY

The Services and all materials (text, images, graphics, logos, product designs, photographs, video, audio, and their selection/arrangement) are owned by Great Spirit Designs or our licensors and are protected by applicable intellectual property laws. This includes original artwork and designs (e.g., collaborations with @sofiscribbles and @gabbymonterroso) used on our goods.

You may use the Services for personal, non-commercial purposes only. No license is granted except as expressly provided. Do not copy, reproduce, modify, distribute, publicly display, or create derivative works from the Services or our products without written permission. Great Spirit Designs names, logos, and product names are trademarks of Great Spirit Designs. Shopify and other names are the trademarks of their respective owners.

7. OPTIONAL TOOLS

We may provide access to third-party tools “as is” and “as available” without warranties or endorsements. Your use is at your own risk and is subject to the third party’s terms. Future new features/tools are also subject to these Terms.

8. THIRD-PARTY LINKS

Third-party links or embedded content may appear on the Services. We are not responsible for examining or evaluating such content and are not liable for any harm or damages arising from your use of third-party websites or services. Review third-party policies before engaging in any transaction.

9. RELATIONSHIP WITH SHOPIFY

Great Spirit Designs is powered by Shopify, which enables us to provide the Services. Any purchases you make are directly with Great Spirit Designs. Shopify is not responsible for your purchases with us. You expressly release Shopify and its affiliates from claims arising from your transactions with Great Spirit Designs.

10. PRIVACY

Personal information you provide is governed by our [Privacy Policy], and certain data may also be processed under Shopify’s Privacy Policy to operate and improve the Services. Information may be processed outside your jurisdiction. See our Privacy Policy for details.

11. FEEDBACK

If you send us reviews, ideas, or suggestions (“Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, and display that Feedback in any medium for any lawful purpose. You represent you own/hold rights to your Feedback and that it does not violate others’ rights or applicable law.

12. ERRORS, INACCURACIES & OMISSIONS

At times, the Services may contain errors or omissions related to product descriptions, pricing, promotions, shipping charges, transit times, or availability. We reserve the right to correct, update, or cancel orders based on such information at any time without prior notice (including after an order is submitted).

13. PROHIBITED USES

You may use the Services for lawful purposes only. You agree not to: (a) violate laws or third-party rights; (b) infringe IP rights; (c) harass, abuse, defame, or harm others; (d) transmit malware, spam, or misleading content; (e) scrape, crawl, or interfere with security features; (f) impersonate others; or (g) engage in conduct that restricts or inhibits anyone’s use of the Services. We may suspend or terminate access for violations.

14. TERMINATION

We may terminate or suspend the Services (or any part) at any time without notice. You remain liable for amounts due up to the termination date. Sections that by nature should survive termination will continue to apply (including IP, Feedback, Disclaimers, Limitation of Liability, Indemnification, Governing Law).

15. DISCLAIMER OF WARRANTIES

Except as expressly stated by Great Spirit Designs, the Services and all products are provided “as is” and “as available” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, durability, title, and non-infringement. We do not warrant uninterrupted, timely, secure, or error-free operation. Some jurisdictions do not allow certain disclaimers; these may not apply to you to the extent prohibited by law.

16. LIMITATION OF LIABILITY

To the fullest extent permitted by law, in no case shall Great Spirit Designs, our owners, officers, employees, partners, contractors, service providers, or licensors be liable for any indirect, incidental, punitive, special, or consequential damages (including lost profits, lost revenue, data loss, or replacement costs) arising from your use of the Services or products, even if advised of the possibility. In all cases, our total liability shall not exceed the amount you paid for the product giving rise to the claim.

17. INDEMNIFICATION

You agree to indemnify and hold harmless Great Spirit Designs (and Shopify) and our respective affiliates, officers, employees, and agents from claims, losses, liabilities, damages, and expenses (including reasonable legal fees) arising out of your breach of these Terms, violation of law, or misuse of the Services or products.

18. SEVERABILITY

If any provision of these Terms is found unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted and the remainder will remain in full force and effect.

19. WAIVER; ENTIRE AGREEMENT

A failure to enforce any provision is not a waiver. These Terms, together with policies posted on the site (including [Privacy Policy], [Refund & Exchange Policy], and [Shipping Policy]), constitute the entire agreement between you and us and supersede prior understandings.

20. ASSIGNMENT

You may not assign or transfer these Terms without our prior written consent. We may assign or transfer these Terms without notice.

21. GOVERNING LAW

These Terms and any disputes will be governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein. You consent to the exclusive jurisdiction and venue of the courts located in British Columbia, Canada.

Headings are for convenience only and do not limit the Terms.

23. CHANGES TO TERMS

You can review the current Terms at any time on this page. We may update these Terms by posting changes on the website and will notify you of material changes as required by law. Your continued use of the Services after changes constitutes acceptance.
